ACCEPTANCE OF TERMS
These terms of sale are entered into by and between You and Rent Sons Inc. DBA Surv ("Surv", "we" or "us"). The following terms (collectively, these "Terms and Conditions"), govern your use of the services offered by Surv (the "Services"). The offer of Services through our website, in person, phone system, text message, mobile application (collectively, the "Site") is expressly conditioned upon your acceptance of these Terms of Sale. You will be deemed to have accepted these Terms and Conditions by submitting a Services request. Use of the terms "you" or "your" in these Terms of Sale, as the context requires, means and includes the person or entity on whose behalf the Services are being procured (the "User"). User is fully responsible for compliance with these Terms.

GENERAL GUIDELINES

Requests
After you complete a Services request on the Site, our Neighbor Success Team will match your Services request to available Local Workers. "Local Workers" are Surv employees who perform Services. Surv does not guarantee that any particular Services request will be fulfilled. If your Services request cannot be fulfilled, you will be informed by the scheduler as soon as reasonably possible.

We're Quality! But We Aren't Pros
When you hire Local Workers, you hire dedicated and hardworking individuals committed to delivering quality service. While they may not have decades of experience or high-end equipment, their skill and effort consistently exceed expectations for most jobs. In certain cases, our scheduling team may recommend leaving the task to specialized professionals for the best outcome. However, we do realize that choosing the right level of expertise is important and we thoughtfully consider the team members we assign to your project(s). If we don't feel confident in our ability to perform the scope of work prior to booking the job, we will say so. Rest assured, it is not in anyone's best interest for us to take on work we're not confident in completing.

Estimates & Scheduling

Accuracy of Estimates:
Before scheduling your job, we will review the details with you and provide an estimate based on the information you share with us. Estimates serve as a projected cost and may differ from the final invoice. Accuracy and transparency are top priorities, ensuring clarity and confidence in every estimate. Delivering precise time assessments benefits both our team and our clients, making accuracy a key focus in our process. However, various factors including but not limited to site preparation, the scope of work being different from what was initially disclosed to our team, delays occurring in supply chain, unanticipated challenges, added safety procedures and weather conditions can all affect the final invoice.

If our estimate differs from your expectations, you are welcome to proceed based on your own time assessment. However, completion within a self-determined timeframe depends on various factors, and our team operates with a focus on quality and efficiency as it is mutually beneficial. Worker performance can be subjective and reductions to the final bill are uncommon unless project efficiency is impacted by our failing or delay in providing requested equipment, materials, or tools on the day of service.

Content of Estimates:
The estimates we curate will include estimated costs for the services, materials, tools and equipment required to complete the project. Estimates sent exclude surcharges or other additional fees and will be included on the final invoice.

Delivery of Estimates:
Before scheduling a job, you must approve our estimate, which will be communicated verbally or via text and/or email from a Surv representative. We maintain a comprehensive record of all incoming and outgoing communications, including verbal agreements, text messages, and emails. If you do not have a written copy of the estimate and later dispute the final bill, you remain financially liable for the services completed at your home. It is your responsibility to ensure that you receive and retain a copy of the estimate. Due to factors beyond our control, such as your internet service provider's settings or spam filtering software, you may not receive our email communications.

If you have not received an estimate, it is your prerogative to request that we send it via an alternative method. Otherwise, we are not responsible for any claims of non-receipt, as we maintain system records of sending the estimate. Verbal approvals are considered equally valid, as we may maintain recordings of all incoming and outgoing calls for verification purposes.

Required Deposits:
Once the estimate is approved, we will proceed with scheduling your project, at which point a deposit will be required. While we can place a hold on your preferred date and time, services cannot be guaranteed without receiving the deposit. To ensure a smoother service experience, we charge the deposit at the time of booking. If we do not receive the deposit payment we may cancel the project. Deposits are structured as follows:

  • For estimates totaling less than $1,000, a deposit of 25% of the estimated value is required before booking.
  • For estimates of $1,000 or more, a deposit of 50% of the estimated value is required before booking.

These deposits enable us to allocate the necessary resources and personnel to successfully complete your project. Please rest assured that deposits are fully refundable, except under the circumstances outlined in our cancellation policy.

Payments and Billing
Payments for services are due upon completion of the work. We will automatically charge the card we have on file for the full amount due once the services are completed, and a written copy of the final invoice will be promptly sent to you for your records.
If for any reason you do not receive the invoice, whether due to email delivery issues or other circumstances, you can request that we resend it via an alternative method, such as text, email, or postal mail. We are dedicated to ensuring you have access to the invoice for reference and record-keeping.
We reserve the right to place a hold on the card provided for the entire estimated amount. If the hold fails, the card is removed from the file, or there are insufficient funds in the payment method you provided, we may choose to discontinue services, even if we are already on-site. In such cases, we will not be held liable for any damage to your property that may occur due to ceasing services, especially if we are unable to resolve the matter promptly.

You Pay for the Scheduled Time:
Surv charges for the scheduled time, even if our workers complete the work ahead of schedule. This policy ensures that the time reserved for your project is properly allocated, regardless of whether the task is finished sooner than expected.
In the event that our workers finish early, we typically offer to utilize the remaining time by asking if there are any other tasks or additional work you would like us to complete. However, if the work requested is unsafe or beyond our team's capabilities-such as requiring specific skills, tools, or equipment-we may decline to perform it. In such cases, you are free to find alternative tasks for us to do, as long as they are within the scope of what we can safely and efficiently handle. It remains entirely your responsibility to make the most of the time scheduled, and we encourage you to be prepared to suggest any additional work within the boundaries of safety and feasibility.

Change Orders for Labor ("Services"):
Surv workers are available to continue beyond the scheduled time, provided they can extend their hours as needed. This flexibility helps ensure timely project completion while ensuring fair compensation for additional labor. If a job requires more resources than originally planned, we will make every effort to allocate suitable, available workers to meet work order requirements, particularly if the project has a specific deadline or urgency.

  • If we provide the original project estimate, any additional time will be billed at a prorated rate in fifteen-minute increments, up to a maximum of 25% of the initially estimated time.
  • If the time estimate was determined by you, additional time will be billed at a prorated rate in fifteen-minute increments based on the actual time worked.

Change Orders for Materials and Dump Fees ("Materials"):
Material and dump fee estimates are calculated based on average cost projections using the best available data at the time of estimation. These estimates are designed to provide a reasonable expectation of expenses; however, actual costs may vary due to project-specific factors. Any necessary adjustments will be reflected in the final invoice.
For optimal project completion, additional materials may sometimes be required to maintain quality standards. These unforeseen needs can affect the final cost. Similarly, dump fees are determined by the volume or weight of materials disposed of, which may fluctuate based on project requirements and disposal site regulations.
We prioritize accuracy in all estimates and strive to provide the most precise projections possible. However, all estimated amounts remain subject to change based on actual conditions encountered during the project and we reserve the right to bill these items accordingly.

Past Due Payments:
Payments are considered past due if not received within 24 hours of job completion. If the final invoice remains unpaid for more than 30 days, we will apply an interest charge of 10% per month to the outstanding balance.
If you fail to address the unpaid balance, either verbally or in writing, or if you neglect to respond to our attempts to resolve the matter, we reserve the right to explore other options to recover the debt, which may include:

  • Pursuing a settlement through small claims court
  • Forwarding the balance to a collections agency, which could impact your credit score
  • Placing liens on any applicable property, as permitted by law

That said, we prefer to handle payment issues amicably. With approval from our financial department, we may be able to offer flexible monthly payment arrangements, subject to a 10% interest charge on the final invoice balance.

Insurance, Property Damage and Personal Injury
Each Local Worker is covered by a $1 million General Liability Insurance Policy. You may request a copy of our insurance certificate at any time. In the unlikely event that items are damaged beyond reasonable wear and tear during the course of the job, you are still responsible for the cost of services rendered. Surv can cover up to $1,000 out-of-pocket for damages to items beyond reasonable wear and tear if the resulting damage is beyond repair. Reasonable wear and tear includes structural or cosmetic minor scratches to furniture, walls, or other surfaces during the course of work. If damages exceed $1,000, the General Liability Insurance Policy will apply, with damage assessments handled by the insurance adjuster if we are unable to repair the item satisfactorily.

Claim Qualifications:
To qualify your claim, you must get in touch with us whether by phone call or written communication to submit a claim and the claim must be communicated within 24-hours of the job's completion. All claims will only be considered after the final invoice has been paid in full.

We Reserve the Right to Repair:
While we are not obligated to repair incidental damage caused during the services, we reserve the right to make repairs ourselves based on best practices, without requiring your approval of the methods if you seek a solution. If you choose not to allow us to repair the damage, we will no longer be financially responsible.
If repairs are made by anyone other than an authorized person-someone we have not approved in writing to handle the damage-Surv will not be responsible for any associated costs. Surv and the client must mutually agree on the vendor chosen to repair the damages.

Repair Resolution:
If we repair any damaged items and restore them to a condition similar to their original state before the services were performed, we consider the liability resolved and no further action or additional reimbursements are necessary, especially if the damage was structural rather than cosmetic. Once the item is repaired and returned to your home, Surv will no longer be financially responsible for it after delivery. It's important to note that we will always exercise caution when assessing the need for repairs. If we are not confident in our own ability or that of a third party to adequately repair the item, we will not proceed with the repair. In such cases, we will either pay up to $1,000 out-of-pocket or our general liability insurance will cover the costs.

Other Considerations:
If the services provided cause damage or injury, Surv's liability is limited to a maximum of $1,000, and we are not responsible for beyond this amount. To file a claim, you must provide a detailed description and photographs of the affected items both before and after the incident caused by Surv's services. Please note that we are not liable if the job was based on a self-determined estimate or if the Local Worker relied on your direction, advice, tools, or supplies during the performance of services. Additionally, if the scope of work completed at the time of the incident was not explicitly listed in the estimate and was added ad hoc on the day of service, Surv is not responsible for any resulting damage(s).

Lunch Breaks
As applicable by Law, Local Workers scheduled for 6 or more hours of work are entitled to a 30-minute paid lunch break, which is included in the total cost of the scheduled time.

Sunday & Holiday Jobs
If your timing is not flexible, we may accommodate a holiday or Sunday job at Surv's discretion. Please note that the price for such jobs will be adjusted accordingly, as our rates are higher on these days.

Disputes and Liability
In the event that you have a dispute with a Local Worker, you release Surv from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL SURV, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS (INCLUDING, WITHOUT LIMITATION, OUR COMMUNITY BUILDERS) BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

CANCELLATION & RESCHEDULE POLICY
At Surv, we understand that life is unpredictable and unexpected events can occur. We also understand that unexpected events can disrupt even the most carefully planned schedules. Therefore, we have established a cancellation and reschedule policy to ensure that we can provide the best possible service to our customers while maintaining the integrity of our business operations.
When a customer cancels or reschedules a job with short notice, it results in lost revenues and lower productivity and pay for our workers. These losses can significantly impact our ability to provide quality services to all of our customers. For this reason, we must impose a cancellation fee if you cancel or reschedule within the specified notice period according to the following fee schedule:

We understand that unforeseen circumstances such inclement weather, and we review these situations on a case-by-case basis. If you have a legitimate emergency, we will likely waive the cancellation fee and reschedule the job.

We want to emphasize that our cancellation policy is not intended to punish our customers. It is simply necessary for us to protect our business and maintain the level of service that our customers expect from us. We hope that you understand and agree to these terms when you book with us.

KEEP OUR LOCAL WORKERS SAFE

  • Moving: The jobsite manager or office manager may decide a moving job is too strenuous or difficult for the Local Workers on site.
  • Landscaping: Although we are insured, we do not use power tools like chainsaws or climb tall ladders (exceeding 20ft)
  • Roofs: We do not go on roofs.
  • Painting: Exterior projects that include multi-story projects must be arranged with the office prior to scheduling. We have experienced Local Workers that can paint your house, but we need a heads up in advance of booking, otherwise we may not be able to do the job that day.
  • Uncleanliness: If the job site has black mold, feces, hazardous chemicals, or if there are other hazardous conditions at your house, you should call a professional.

PLACEMENT FEES
Surv is committed to providing valuable services to our customers. For this reason, we charge a placement fee for any case in which a "Neighbor" (customer) chooses to hire, contract or arrange services with a Surv employee without obtaining consent of the employer, so long as those services are within the scope of work that Surv provides. All Surv employees, or "Local Workers," are employees of Surv; they have no authority to bind Surv or you and they shall not make any agreements or representations on Surv's or your behalf without Surv's prior written consent. The placement fee is $5,000, which covers costs associated with hiring and planning for our recruitment needs. This fee is collected upon agreement of service by the Neighbor. The fee is non-refundable, and the signed agreement between you and Surv will outline the specifics of the fee schedule. If after being hired for the job, the Local Worker does not meet the expectations of the Neighbor during their term of employment, the placement fee is non-refundable. If the Neighbor decides to terminate the employment of the Local Worker prior to the completion of the agreed upon services, the placement fee will not be refunded. The Local Worker is responsible for completing the agreed upon services and is held to the standards outlined by Surv. If the Local Worker fails to complete the services, the placement fee is still non-refundable. Surv reserves the right to change the terms of this policy at our discretion. Any changes to the policy will be posted on the Surv website, and it is the responsibility of the customer to check for changes. By using the services of Surv, you are agreeing to the stated Terms and Conditions of this policy and therefore agree to be bound by the rules and regulation outlined herein.

PHOTO RELEASE
As a Surv customer, I grant permission to use my likeness/home in a photograph, video, or other digital media ("photo") in any and all of its publications, including web-based publications, without payment or other consideration.
I understand and agree that all photos will become the property of the Surv and will not be returned. I hereby irrevocably authorize the Surv to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
I hereby hold harmless, release, and forever discharge the Surv from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

MISCELLANEOUS

  • If Surv cannot perform any of its obligations because of events beyond our reasonable control, then Surv will not be liable to you for failure to perform.
  • Surv has no obligation to make repairs to any incidental damage that results from providing the Services. In the event that the Services result in damage or injury, Surv shall only be responsible for damages up to $1,000 and shall not be liable to you for money damages exceeding that amount.
  • In the unlikely event we damage items that are beyond reasonable wear and tear, we will cover up to $1,000 out-of-pocket for the items or the $1 million general liability insurance policy will handle it.
  • Surv is not liable for any damage caused by insufficient disclosure in writing of the value, weight and/or fragility of items that are handled in connection with the Services. If such items have a value over $1,000, you are required to disclose the value to us in writing prior to performance of the Services.
  • No waiver by Surv of any term or condition set out in these Terms of Sale shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Surv to assert a right or provision under these Terms of Sale shall not constitute a waiver of such right or provision.
  • If any provision of these Terms of Sale is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Sale will continue in full force and effect.
  • The Terms of Sale, Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Surv regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
  • Surv may revise and update these Terms of Sale from time to time in our sole discretion. All changes are effective immediately, and apply to all Services requests made through the Site thereafter. Any changes to these Terms of Sale will not apply to any Services request received by us before such changes are made.

Rent Sons Inc. DBA Surv ("We" or "Surv") respects the privacy of our Local Workers, Neighbors, Community Managers and guests, and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit our online interfaces and properties (e.g., websites and mobile applications) owned and controlled by Surv, including the website www.rentsons.com (collectively, the "Site") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • On the website.
  • In email, text and other electronic messages between you and this Site.
  • Through mobile applications you download from this Site, which provide dedicated non-browser-based interaction between you and this Site.

  • Surv and/or Local Workers offline or through any other means, including on any other website operated by Surv or any third party; or

If you do not agree with our policies and practices, your choice is not to download, register with, or use our Site. By downloading, registering with, accessing or using this Site, you agree to this privacy policy. This policy may change from time to time. Children Under the Age of 13

Our Site is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Site. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Text Message Communications

By providing your mobile number during the registration process, you agree to receive operational messages (including without limitation job reservation confirmations and job detail reminders) from Surv via text message. You agree that such texts may be generated by automated telephone dialing systems, and that consent is not a condition of purchase. For help, email [email protected]. Message & data rates may apply. You understand that opting out of receiving such text messages may impact your use of the Surv site.

Information We Collect Through Automatic Data Collection Technologies

As you download, access, use and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Site, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Site.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking).
